General provisions

These conditions are valid exclusively between the company ORO DI SICILIA S.R.L., with registered office in via Garibaldi 46/A Nubia – 91027 Paceco (TP) Italy, REA TP-176592, VAT 02512510815, hereinafter referred to as "Saline Culcasi" and any person who makes online purchases on the website www.salineculcasi.it hereinafter referred to as the "CUSTOMER". These conditions may be subject to change and the date of publication of the same on the site is equivalent to the date of entry into force.

These conditions govern purchases made on the www.salineculcasi.it website, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree No. 206/2005, amended by Legislative Decree No. 21/2014 and Legislative Decree 70/2003 on electronic commerce.

ARTICLE 1 - Object of the contract

With these general terms and conditions of sale, SALINE CULCASI sells and the CUSTOMER purchases at a distance the tangible movable goods indicated and offered for sale on the www.salineculcasi.it website.

The contract is concluded exclusively through the internet, through the access of the CUSTOMER to the www.salineculcasi.it address and the execution of a purchase order according to the procedure provided by the site itself. The customer undertakes to read, before proceeding with the confirmation of his order, these general conditions of sale, in particular the pre-contractual information provided by SALINE CULCASI and to accept them by placing a flag in the box indicated.

ARTICLE 2 - Pre-contractual information for the consumer - Article 49 of Legislative Decree 206/2005

Before concluding the purchase contract, the CUSTOMER reads the characteristics of the goods that are illustrated in the individual product sheets at the time of choice by the CUSTOMER.

Before validating the order with "obligation to pay", the CUSTOMER is informed about:

• total price of the goods including taxes, with details of shipping costs and any other costs;
• payment methods;
• information that the CUSTOMER will have to bear the cost of returning the goods in the event of withdrawal;
• existence of the legal guarantee of conformity for the goods purchased;
• after-sales service conditions and commercial guarantees provided by SALINE CULCASI.

The CUSTOMER may at any time and in any case before the conclusion of the contract, become aware of the information relating to SALINE CULCASI, the geographical address, telephone number, e-mail address, information that is also reported below:

ARTICLE 3 - Conclusion and effectiveness of the contract

The sales contract is considered concluded with the sending by Saline Culcasi to the CUSTOMER of an order confirmation e-mail. The e-mail contains the CUSTOMER's data and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent.

The CUSTOMER undertakes to verify the correctness of the personal data contained in the above email and to promptly notify SALINE CULCASI of any corrections/changes to be made.

SALINE CULCASI undertakes to describe and present the items sold on the site in the best possible way. However, there may be some errors, inaccuracies or small differences between the product depicted on the site and the actual product. Furthermore, the photographs of the products presented on www.salineculcasi.it do not constitute a contractual element, as they are to be considered only representative and subject to variations in the packaging.

SALINE CULCASI undertakes to deliver the goods within 30 days from the sending by SALINE CULCASI of the order confirmation e-mail to the CUSTOMER.

ARTICLE 4 - Availability of products

Product availability refers to actual availability at the time the CUSTOMER places the order. However, this availability must be considered purely indicative because:

• the products may be sold to other CUSTOMERS before the order is confirmed, as a result of the simultaneous presence of several users on the site,
• A computer anomaly could occur such as to make a product available for purchase that is not actually available.

Even after sending the order confirmation e-mail sent by SALINE CULCASI, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically rectified with the deletion of the unavailable product or products and the CUSTOMER will be immediately informed by e-mail; With this e-mail, the customer will also be informed of the methods and timing of reimbursement of any sums paid.

ARTICLE 5 - Payment methods

Any payment by the CUSTOMER can only be made by bank transfer or PayPal payment method.

In case of payment by bank transfer, the actual confirmation of the order will take place only when the amount is received on the bank account of SALINE CULCASI, the CUSTOMER will be notified, the order prepared and ready for shipment.

In case of payment by PayPal, the actual charge will take place when SALINE CULCASI sends the order confirmation e-mail.

Communications relating to the payment and the data communicated by the CUSTOMER at the time it is made take place on special protected lines.

ARTICLE 6 - Prices

All the sale prices of the products indicated on the www.salineculcasi.it website are expressed in Euros and include VAT.

Shipping costs are not included in the purchase price, but are indicated and calculated at the time of completion of the purchase process before payment is made.

The CUSTOMER accepts the right of SALINE CULCASI to modify its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time of creation of the order and indicated in the confirmation e-mail sent by SALINE CULCASI to the CUSTOMER.

In the event of a computer, manual, technical, or any other error that may lead to a substantial change, not foreseen by SALINE CULCASI, of the sale price to the public, which makes it exorbitant or clearly derisory, the purchase order will be considered invalid and cancelled and the amount paid by the CUSTOMER will be refunded within 14 days from the day of cancellation.

ARTICLE 7 - Right of withdrawal

The CUSTOMER has the right to withdraw from the purchase without any penalty, within 7 days from the date of receipt of the products.

The CUSTOMER who intends to exercise the right of withdrawal must communicate it to SALINE CULCASI by means of an explicit declaration, which can be sent by registered mail with return receipt or by sending an email to info@salineculcasi.it or by certified email to: orodisicilia@pec.it.

In the event of exercising the right of withdrawal, the CUSTOMER is required to return the goods at his/her own care and expense within 7 days from the day on which he/she communicated to SALINE CULCASI his/her intention to withdraw from the contract pursuant to Article 57 of Legislative Decree 206/2005.

The goods must be sent back to SALINE CULCASI, via Garibaldi 46/A Nubia – 91027 Paceco (TP) Italy.

The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessories) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, SALINE CULCASI will refund the amount of the products subject to withdrawal within a maximum period of 14 days.

As provided for by Article 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, SALINE CULCASI may suspend the reimbursement until receipt of the goods or until the CUSTOMER has demonstrated that he has sent the goods back to SALINE CULCASI.

SALINE CULCASI will make the refund by making a bank transfer to the CUSTOMER, who must provide his/her IBAN code and related details to SALINE CULCASI, by email or certified email to the following addresses: info@salineculcasi.it - orodisicilia@pec.it.

ARTICLE 8 - Legal guarantee of conformity

In the event of receipt of damaged products due to transport, the CUSTOMER is entitled to a replacement of the product free of charge. If the defect is already evident (external appearance of the package e.g. greasy/wet package) during the delivery of the product, the CUSTOMER must accept the goods subject to inspection. As soon as the package is opened, THE CUSTOMER must immediately take photos of the damaged products and send the photographic evidence to the following addresses: info@salineculcasi.it - orodisicilia@pec.it.

SALINE CULCASI, in the event of proven damage, will organize, at its own expense, the eventual collection of the product, compatibly with the availability of the CUSTOMER.

ARTICLE 10 - Delivery methods

SALINE CULCASI will only accept orders to be delivered in the Italian territory. The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order no later than 30 days from the date of receipt by the CUSTOMER of the order confirmation e-mail sent by SALINE CULCASI. Our couriers do not deliver on Saturdays, Sundays and national holidays.

For each order placed on the www.salineculcasi.it website, SALINE CULCASI issues an invoice for the goods shipped. The invoice will contain the information provided by the CUSTOMER during the purchase process. After the invoice has been issued, it will not be possible to make any changes to the data indicated in the same.

ARTICLE 11 - Liability

SALINE CULCASI does not assume any responsibility for inefficiencies attributable to force majeure or fortuitous circumstances, even if dependent on malfunctions and inefficiencies of the internet network, in the event that it is unable to execute the order within the time limits set out in the contract.

ARTICLE 12 - Access to the site

The CUSTOMER has the right to access the site for consultation and purchases. Any other use, in particular commercial use, of the website or its content is not permitted. The integrity of the elements of this site, whether sound or visual, and the related technology used remain the property of SALINE CULCASI and are protected by intellectual property rights.

ARTICLE 13 - Cookies

The www.info@salineculcasi.it website uses cookies. Cookies are electronic files that record information relating to the CUSTOMER's navigation on the site (pages consulted, date and time of consultation, etc.) and that allow SALINE CULCASI to offer a personalized service to its customers.

SALINE CULCASI informs the Client of the possibility of deactivating the creation of these files, by accessing its Internet configuration menu. It is understood that this will prevent the Customer from proceeding with the online purchase.

ARTICLE 14 - Entirety

These General Terms and Conditions of Sale consist of all the clauses that compose them. If one or more provisions of these General Terms and Conditions of Sale is deemed invalid or declared invalid under law, regulation or following a decision by a court having jurisdiction, the other provisions will continue in full force and effect.

ARTICLE 15 - Applicable law and jurisdiction

These General Terms and Conditions of Sale are subject to Italian law.
